13 is not enough of a buffer. I'll take 13 if we can get it but 15 is the number to go for. If conservatives are gonna raise hell anyway might as well give them a damn fine reason.

I would add circuits. Some of them are just too big. Of course I also think the House should have about twice as many Representatives and the Senate should have three members from each State.

I've had same thought. Is it a number, or should it be 1 from each circuit? How do we get there from current set-up? 3 from DC Circ., one from 1st, one from 2nd, one from 3rd, one from 10th, and Kagan from where (NY, DC, MA)? Normally it's NYers, Harvard & Yale profs & DC attys.

The rule should be one circuit, one justice. The circuit justice allotments are made by the Chief Justice (though I imagine he takes requests). Since 9 Justices have to cover 13 circuits, even before Ginsburg died you had Roberts, Alito & Sotomayor covering more than one each.pic.twitter.com/yXKgk42Zfm
