      @csoghoian I am not sure at all that Apple is not doing the right thing by encrypting end to end.

          @benjaminwittes And is Apple doing the right thing or wrong thing by backing up those same messages, unencrypted, to its iCloud service?

          @csoghoian @benjaminwittes Apple isn't. Do research.http://techcrunch.com/2014/02/27/apple-explains-exactly-how-secure-imessage-really-is/ …

          @lofdev @csoghoian The service in question is public key management.

          @benjaminwittes @csoghoian Your theory of why these hypothetical civil claims against Apple aren't barred by 47 U.S.C. § 230 is … ?

        2. Benjamin Wittes ‏@benjaminwittes 30 Jul 2015

          @grimmelm I don't think 230 covers point to point communications. It's a liability shield for restricting access to offensive content.

        3. James Grimmelmann ‏@grimmelm 30 Jul 2015

          @benjaminwittes (1) 230 applies to email, which is also point-to-point. (Batzel v. Smith) (2) iMessage pushes messages through Apple servers

          @grimmelm @benjaminwittes Any follow up on this Ben? 230 is a pretty steep civil barrier to overcome.

        @benjaminwittes @csoghoian Especially if the theory is that Apple is liable for not cutting off a communications service after a warrant.

        @benjaminwittes @csoghoian NOT encrypting communication is irresponsible and should be banned. I don't want to have my accounts hacked.

        @benjaminwittes @csoghoian BTW, you're using the phrase "end to end" wrong, unless you're talking about iMessage, rather than disk crypto.
