If you’re a journalist and you’re giving libel lawyers a platform to claim social media is publishing, you need to have a serious think.
@adambanksdotcom @DarienGS Not sure that Article 10 affords Twitter any more protection than any other form of communication.

@bazzacollins@DarienGS I’m arguing it affords it no less. Just that. -
@adambanksdotcom@DarienGS But as Darien says, that still exposes it to libel/defamation cases. Not sure what distinction you're drawing? -
@bazzacollins@DarienGS Simply that rules made for “the press” shouldn’t be newly applied to casual conversation. Is that so extreme? -
@adambanksdotcom@DarienGS A tweet that reaches 130 followers shouldn't be treated the same as a libel in the Daily Mail. -
@bazzacollins@DarienGS Nor should a tweet that reaches 130 million, unless it was produced under the same editorial regime as Daily Mail. -
@adambanksdotcom@DarienGS Disagree with you there. In no other branch of the law is the competence of the offender a factor in guilt. -
@bazzacollins@DarienGS You’ve surely got to be kidding. When I stick a plaster on next door’s kid I’m not held to GMC standards. -
@adambanksdotcom@DarienGS Yeah, fair point. That was a silly comment made in haste. Good job this isn't legally enforceable, eh? *Phew*
