It's a 2-sided problem. If you argue protecting the vaccinated, you have the issue that the vaccinated are not in serious danger. If you argue protecting the unvaccinated - which is less politically satisfying - you run into the fact that they've made their own choice.

Regardless, the courts have granted OSHA and the Sec of Labor very wide latitude here to determine what constitutes “grave danger.” The case law is overwhelming.

One other point to make here and it’s an obvious one—25% of the workforce is unvaccinated and they pose a grave danger to *each other.* And, given how many of them there are, workplaces will obviously include multiples numbers of them (true even in health care facilities).
