Yes, and no. It is not legitimate when it involves areas in which the federal government was never meant to regulate, per the Constitution. Commerce clause abuse by SCOTUS has imposed a different federal regime than that agreed to by the several states.

People may say "but we live in a vastly different world from that of the Founding Fathers," but, they provided a means to make changes to the Constitution, through amendment, rather than judicial redefinition.
