Maybe. Perhaps even probably. But Congress still hasn't authorized it. The CDC was exceeding its authority, and the SCOTUS made that pretty clear.

They’ve known for over a month that it was going to expire but did not pass a bill to statutorily enact a moratorium. They didn’t have the votes and now they are looking to deflect from the fact that they are on a 6-week vacation.

Its also a great example of how Congress tries its best to hand over its responsibilities to other agencies/branches of government so they won’t be blamed at the ballot.
