That's a fair criticism of the Biden administration's policy, but obviously it's whataboutism. If you meant, "That's fair" w/ a challenge to Steve to apply such criticism even-handedly, great. You should say so clearly. If you meant anything else... You should really clarify.

Raising federal policy on COVID is absolutely something that would come up in litigation, especially if this is framed as a rational-basis style of argument about the reasonability of suspicion.
