Just because there is no general federal common law does not mean there is no federal common law. Occasionally, in areas such as this one, the Court still just decides rules of law based on traditional fairness values.

Patent cases are rare cases in the Supreme Court. Most judges don't like them and for the Court to take one up and issue an opinion is big news in the patent world.

Yeah, this is obviously a big case. But my grounding in patent law is about an inch deep.
