    It's pretty obviously true that if the Democratic-controlled state of New York prosecutes the recent former president, the people who believe that the 2020 election was stolen are going to be even more convinced that we're witnessing an actual coup d'etat.

        Which they likely won’t get because Trump used certified tax preparers. intent of such crimes is going to be basically impossible for the prosecution to make and at worse this will fall back to a civil issue ie fines and penalties. If the issues even exist in the first place

        Why "absolutely not"? Is a former president more equal than those who are not "ordinary citizens" or who are being prosecuted under rules that are less than well-settled? I agree that the weaponization of the criminal justice system for political purposes is pernicious.

        Criminal prosecution of political opponents is banana republic stuff. Vindictive and mean. Trump may have scored some cheap points leading "Lock her up!" chants about HRC but he never actually brought charges. This would set a bad precedent.

        The majority of successful prosecutions of ordinary citizens are either (a) not a perfect slam-dunk, and/or (b) not regularly prosecuted, and/or (c) based on laws that are varying degrees of contested, unsettled, etc. Why should former presidents be treated differently?
