Moreover the "national popular vote" in the Senate is not only contrary to how the Senate has always worked, it's a deeply misleading measure given that California's system keeps Republicans off the November ballot even though there are millions of Republican voters in the state.

The country as a whole has drifted toward agreeing with the basic concept that judges should interpret law and not make law. Very few conservative judges are truly controversial anymore with the general public.

The Senate majority went ahead and trusted Arlen Specter to chair the committee even though some Republicans openly worried. Roberts was offered as a non controversial nominee with a noninterventionist philosophy. Alito of course ended up being a pick to please the base.
