Yeah, the fact that Roberts isn't presiding is bizarre. Impeachments are for President, Vice-President and "Officers of the United States". He's not VP, and ex-President isn't generally considered an officer. If he's not being tried as President, he shouldn't be on trial at all.

And if he is on trial as President, Roberts needs to preside over that trial. In no case should Leahy be presiding. Either Roberts is there, or it's moot and can't be tried.

I don't know, the President (Joe Biden) is not on trial. I understand that the question of whether an ex-President can be removed is less clear and I understand the multiple reasons why you think he can be. But whether the CJ would preside seems perfectly clear.

I don’t know why his non-judicial, personal opinion would be any more relevant than anyone else’s. It would certainly not set any precedent. And I think he’s very sensitive to that point.

The courts are generally far more averse to issuing advisory opinions than the AG. And he’s just one person on a 9-person court. And neither Trump nor the Senate is apparently demanding his presence, much less in a legal action.
