How are people surprised that a Senator could preside over an impeachment trial, while also voting in it? That has happened in every impeachment of a judge or Cabinet member ever. It is precisely how the constitutional process is designed.
And yet, they based impeachment on British practice, which allowed this. They explicitly wrote into the constitution of states such as Virginia that *only* former governors could be impeached (some Virginians tried to impeach Jefferson for his conduct as Governor).
