      Jonathan is right. The consensus was the other way. And Congress has conducted itself consistently with that. The congressional precedents go beyond just the cases in which they actually tried someone who was already gone.       I wrote that article 20 years ago and it processes a lot of evidence and arguments on both sides (and there is plenty on both sides). I have yet to hear an argument on the other side that shows a real familiarity with all of that evidence and all of those arguments.

      Article II, Section 4 of the Constitution states: “The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.” Open and shut case.

      That's in Article II because it limits the power of those executive officers. Article I is where the authority for impeachment comes from.

          You would agree that if CJ Robert’s refuses to preside, that calls into question this constitutional process. Art I, Sec 3 states that the Senate conducts all impeachment trials as follows: “When the President of the United States is tried, the Chief Justice shall preside.
