I thought that was at issue in the Texas v Pennsylvania? That Pennsylvania’s election, and thus its process of choosing electors, was not done in accordance with the wishes of the state legislature.

Yeah, but it was also about whether states have standing to raise those claims. They do not.

Yes. I always thought there was an actual problem that needed (may need?) to be addressed, but none of the later stuff seemed related to it in any meaningful or consequential way.

The idea that granting cert to one case would have stopped the events of Wednesday is laughably ignorant.

I dunno. They were out for blood for Pence. Why wouldn't they be out for blood for Roberts or Kavanaugh or Gorsuch or ACB if SCOTUS threw it out? Not sure humoring him MORE would have helped.

They turned on Pence in a nanosecond! If the SCOTUS had gotten involved then they would have been storming them too. ACB especially would have been targeted as an ungrateful backstabbing B-word.

Also, if McConnell had just given Garland a hearing and then voted him down, the left wouldn’t have claimed that the seat was “stolen.” All they wanted was a hearing.

Which didn't involve enough votes to matter. To be clear I agree, but it is not relevant in election terms.

Extortion works. As will 6 New Democrat justices.

Yes - it’s a minor thing in context but isn’t failure to take PA case yet another example of Roberts’ angling for credibility backfiring? Just allowed issue to harmfully fester
