I teach torts, but couldn't tell you for sure whether NYT v. Sullivan applies in trade libel cases just as it does in other defamation cases. I don't see why not. Should Dominion be treated as a public figure? I'm comfortable arguing "yes." "Actual malice" is a tough putt.

But they won't. Just as Diebold didn't when they were called out for enabling election fraud. Why? Because there probably are security holes built into the software. Memory cards and memory sticks are known as security risks, yet part of the Dominion system.
