      It is deeply disturbing that -- virtually everywhere -- the concerted litigation strategy of the GOP is to make sure that fewer votes count. The strategy goes far, far beyond any legitimate concern about fraud.

      There is a non-trivial chance that we'll know for a fact after the election that its outcome was decided by a judge-made remedy that replaced a written rule of law passed by a legislature. In PA, it appears for now that the late-mailed ballots are to be held separately.

      No. Not “late mailed.” Ballots which are entered prior to Election Day (as indicated by the postmark). As military ballots often are. If you mail your ballot by ejection day, how are you different than showing up to vote in election day? Leaving aside everything else Rs doing.

      The PA decision eliminates any requirement that the ballot be shown to be timely mailed. And again, the legislature set a deadline. The PA Supremes said the deadline was constitutional on its face.

          But your objection is to the idea of even postmarked votes being accepted, right? Do you imagine a tax return day by date, not post mark too? That’s a “neutral” rule. Again, we’re not even tsk king about stuff like trying to eliminate drop boxes. Any justification for that?

          There are disadvantages to a postmark rule rather than a received-by rule, in terms of the logistics of vote counting. But I'm fine with either rule if it is enacted on a uniform statewide basis by the legislature in advance of the election. That's all I ask.
