      It is deeply disturbing that -- virtually everywhere -- the concerted litigation strategy of the GOP is to make sure that fewer votes count. The strategy goes far, far beyond any legitimate concern about fraud.

      1, as we learned from the Gore recount experience, the parties are not always perfect judges of which rules benefit them. 2, a deadline is a deadline - it's the most neutral kind of rule you can have. The Pennsylvania rule is literally the same as saying "this is Election Day."

      Sort of, but deadlines for a *receipt* of a mailed ballot in a period of stress for the postal services create a lot of contingencies that don't obtain with deadlines for *postmarking* a ballot.

      And to 1), sure, but if all Republican litigation is aimed at disqualifying more votes then even if their lawyers have plausible constitutional arguments, a reasonable person might still begin to suspect that Republicans just want fewer votes to count.

      It can both be true that Republican jurists are constitutionally correct - state legislatures should control - and that the combination of that position w/GOP-controlled state legislatures limiting pandemic adaptations means that all R positions converge on counting fewer votes.

      Here's the thing: at some point, there has to be a deadline. There has to be an end. Isn't it more legitimate to have one written by a legislature, than by a court?

          I'm trying to find where it is written that the courts set election rules. I'm pretty sure Article Two of the Constitution gives that authority to the legislature. The states can set their own rules. The judicial branch doesn't legislate.

          It's the Republican voters who, not having the observational skills to find their way out of a wet paper bag, are going to mail their ballots closer to the election and then get them thrown out. Just desserts.

          It’s more legitimate to count all votes postmarked by 11/3. No one knows how long the post office will take, but 9 days should be enough. If there are still votes pouring in on day 9, then keep counting.
