Elections have consequences. If the Dems wish to retaliate in kind, that is entirely legitimate. Blowing up the 9-member Court to take a step Joe Biden has described as a corrupt power grab, which was decisively rejected in 1937 as a threat to a free people, is not "in kind."

If Joe Biden wants to take a step as radical as Court-packing, he should campaign on that & seek the approval of the voters. He's done precisely the opposite.

Power should be exercised to do good, unless a norm exists to constrain it. No historical norm existed to constrain Republicans. Whereas the experience of 1937 set a bright-line historical norm against abuse of power that we all learned in grade school.

Anyway, if you care even a little bit about constitutional governance & the survival of the American republic, go vote for Republicans to hold the Senate. It may be our last line of defense.

Here’s what I don’t get: why is changing the number of justices radical, but falling back on a distinction that existed in the 19th century to block Garland & confirm Barrett isn’t?

Expanding the court has been done far more often then holding a nominee with no vote for 293 days.

Did you read Steve Calabresi’s 2017 manifesto re expansion of the federal courts? All except SCOTUS. Also, as I’m sure you know, plenty of Conservatives argued for shrinking SCOTUS by refusing to confirm a single Clinton nominee. Voters didn’t “vote” on any of this.
