Under an originalist reading of the Constitution Judge Barrett & I could not vote, own property or enjoy the full protection of the law. Senator Kamala Harris would not even be considered fully human. The Constitution is a living, breathing document meant to evolve with the times

In Barbara Lee's case, it's not surprising she does not know the Constitution can be, & has been, amended by the people rather than the courtshttps://twitter.com/RepBarbaraLee/status/1316506258783043586 …

An “originalist” reading of the Constitution would disqualify Judge Barrett, or any woman, from serving on the Supreme Court or from owning property or voting. “Originalism” is a cover for deeply unpopular & un-democratic policies, not some kind of serious judicial philosophy.

The originalist argument in 1865 was, literally, that states could ban slavery, Congress could ban it in the territories, but permanently, federally banning slavery in the states required an amendment - that's why Lincoln, who was an originalist, pushed one through Congress.https://twitter.com/BloodyMathias88/status/1317103063690334208 …

Yeah, the originial constitution is so great it forgot a few things that later needed to be amended, like slavery. Wonder what the originalist argument was in 1865? 🤔 It evolves with the times, folks.

Yes, the Founders expected amendments, made two of them themselves even after adding the Bill of Rights. Originalism is the idea that changing it is the job of the people, not the judgeshttps://twitter.com/RoyalMadjesty/status/1317103454914007042 …

Yeah, but the fact that such a thing as an amendment process exists makes her sentence correct: "The Constitution is a living, breathing document meant to evolve with the times". That's what constitutional amendments are for. They evolve the constitution.

"Originalism" changes meaning every time conservatives apply it to achieve their desired outcome.

You are tweeting in such deliberate bad faith. Coney Barrett is being nominated specifically to nullify "changes made by the people." Republicans have nominated her solely for this task because they can't get their anti-majoritarian agenda across any other way. Shame on you.

the “Bill of rights” are also amendments - they just happen to have been adopted concurrently with the Constitution

The Constitution was signed in 1787, ratified in 1788 with the “promise” of Bill of Rights. Those weren’t added until 1791. Not really a concurrent adoption.

It's only the job of the people when people are allowed to vote which the originalists have repressed. Originalism claims would make changes virtually impossible. It's a cover for maintaining a permanent class of overlords using religious freedom as a mask for grossly unfair laws
