You were caught because you don’t start—pretty much ever—by stipulating to Rs own endless examples of unprincipled behavior—when the examples of manipulating courts are so many. As are the arguments. So sure, when such an argument is pointed out to you (in your own mag) you say

“Oh, not my view!” How about Grassley wanting time sharing the DC Circuit? How about many examples, eg, AZ, of Rs manipulating size of courts? There’s no *principle* here. There are no “norms.” You want that sixth justice? Fine. You’ll probably get away with it. But maybe not.
