The Radical Republicans who ran Congress during Andrew Johnson's presidency had strong, even urgent, reasons to try to thwart Johnson's Reconstruction policies, but they nonetheless almost wrecked the system in trying to strip the presidency of all appointment & removal power.

The GOP didn’t eliminate the seat, they chose not to fill it, as is the right of the Senate under the advise & consent clause of Article 2, Section 2. The Senate is not a rubber stamp.

However, a Republican Senate could during the eight years of a Democratic presidency refuse to even have hearings on two openings on the Court, and that would be constitutional.

More to the point, it means they could temporarily pack the court by 2 for a total of 11, then reduce it by statute back to 9, so the next two to vacate would effectively reset it to 9.
