Also important to note that one of the many thing that the Constitution was seeking to "check and balance" was democracy's excesses. Popular does not necessarily equal good.

It is corrosive in other ways as well. Imagine contract law without any concern as to whether there was a meeting of minds, or what that consensus was! That’s a sure recipe for nihilism.
