      If the Democrats decide to burn down the American republic & the rule of law, we have that fight then. Again, they've been talking about doing that for two years. Harris is for it, Biden won't say. Nothing in my lifetime suggests that backing down will moderate the Dems' demands.

      There is zero assurance that surrendering now gets you out of the court-packing fight. And if the Ds get a majority, which they may anyway, you make them pay the political price for openly destroying the rule of law in the United States.

          All your examples from "fill the seat" are from the 1840's or earlier. Court packing occurred in the 1860's. Seems like there's no cognizant line the GOP can draw anymore.

          Thing is, Dems may pay no (net) price for *moderating* the court. It could even be popular. You have to consider a range of risks here. Dems only have to run faster than the GOP, to escape the bear. Trump's 4 years have been spent poking the bear.
