    Yup. The court is extremely unlikely to invalidate Obamacare. The individual mandate is severable from the rest of the statute under standard rules of statutory construction. https://twitter.com/nytdavidbrooks/status/1310047436505845761 …

        Yeah, it doesn't make any sense if Congress repeals part of a law but not all of it that Congress' intent would be to make the provisions non-severable. Also much more evidence now that mandate was not close to a necessary leg of the stool.

        Gorsuch doesn’t care about overturning precedent either. He just ruled that half of Oklahoma is a Native American reservation.

        True. It would have been easier to do so in 2012 before the law took effect. Now doing so would have real consequences to people currently receiving benefits from the law.

        The Court didn't invalidate Obamacare at the time because Chief Justice Roberts rightly believed that it wasn't the Court's job to overturn a major act of Congress. Only Congress should be able to do that.
