It would be enormously disappointing if ACB did not categorically oppose capital punishment on 6th Am. grounds, as Justices Brennan and Marshall so courageously did for many years.

Can a Catholic judge impose a sentence of death? I think not. And being the 5th vote to uphold a death sentence may be similarly problematic.
