Where is it in the constitution that SCOTUS appointments are pushed through only when President & Senate are the same party? It is actually a surprise to see this, TBH. And not really in line with the "advise and consent" function of the senate. Obstruction is not advice.

Her key point was that Obama’s appointment could dramatically flip the court (wrong of course, Garland was a moderate supported by conservatives), so she would argue that Trump also should not appoint someone.
