This is hackish nonsense designed to pretend something the writer knows not to be true. (Did Biden & Senate Dems change the size of the Court in 1987-88? No.)https://twitter.com/AriMelber/status/1307828256679157762 …

As a historical fact, it's worth noting: Sen. McConnell changed the number of working justices on The Supreme Court from 9 to 8, for well over a year.

So Dan—did you read the quotes David French assembled today from GOP senators in 2016? You will note, or should, that the divided party rationale, which you favor, was entirely post hoc. Fine to say they can do it because they have the power—fair enough. But lots of bs then.

"Entirely post hoc" assumes that Mitch McConnell did *not* cite it at the time, which he did. And so did Grassley. You know this. Why pretend otherwise?pic.twitter.com/TLwBW38uDg

Hey, tell it to brother French! He wrote the citations, not me. Andyou are careful here to note that the rationale oscillates between “not in a presidential year” or, with the additional justification “of the other party.” MM did what any good lawyer does—pile up rationales.

No, election year & opposing party are both conditions together. Opposing parties have never attempted a years-long roadblock. Your argument is that McConnell & Grassley never said the things they said.

No. My arguments is the same as French’s—that GOP Senators didn’t care about any that. They just wanted to spew out some pious bs. There was no good faith here. French gets that—why don’t you? We see—it’s about power.

I practiced law for 23 years. A precedent is still a precedent even if you only cite it because you're trying to win a case for your client.

The violation of a norm is OK if the norm does not exist & never has.

I don’t care about the norm. I care about all the bs. And how it’s obvious that eight months isn’t six weeks and that French’s point. But sure—you want 6-3. This is the dream. Use your power. And maybe Dems will lack the guts to use theirs. And then you’ll win.

Dan’s position - which he falsely obscures despite his professed Catholic fidelity to the 10 Commandments - is that any Dem Prez should be prevented from appointing a Justice forever. There will always be a pretext, but that’s it.
