I practiced law for 23 years. A precedent is still a precedent even if you only cite it because you're trying to win a case for your client.

Fine. But it was on that level of bad faith. And nobody bothered to even *carefully and consistently* cite it. Which, fine, power. Which you would have done in litigation, being a careful lawyer. But again—why are you attacking me, not French? His essay prompted my remarks.
