Of coruse the seat would be open. There’s absolutely no doubt. Also, Hillary would have been impeached quicker than Trump was. Not removed obviously, but it would have given Mitch cover to not hold votes on any of her nominees.

Intrestingly, for the most part, it worked for Dems. Kennedy was far better for them, at least on social issues, than Bork would have been. Also, today, nobody would give a flip about Douglas Ginsburg’s pot use.

And keep in mind too, Dems gave Bork an up or down vote. Douglas Ginsburg withdrew, so they got Kennedy.
