Stop being so disingenuous: Watch the video, as Ernst explains it as though it's the 37th amendment to the Constitution, and it's just how it is, and no one could possibly imagine contravening that. She's ducking the issue by making it seem like it's just a rule that exists.

I think the difference is a scenario where voters booted the president and several senators, but they get to pick a justice anyway. (If Trump wins and there’s a December vacancy there’s nothing really for Dems to complain about.)
