      I’m assuming you would overturn those laws if you could. Do you think that expanding Medicare to cover the entire population is facially unconstitional? How you answer these question has a lot to do with who is burning down what.

      One, I agree that there'd be some hard questions about stare decisis and reliance interests if the Court started taking enumerated & separated powers seriously again. Whereas these folks are cutting straight to destruction. Two, they're doing so on the lawmaking process itself.

          I appreciate your honesty re #1, although you haven’t paused to consider that “limited government” is wildly not popular (and in the form you describe it, radically legally activist—only limited for some, but not others.) But re the “law making process itself” the super majority
