In abortion case, Roberts does what no liberal Justice would do on a hot-button social-issue case: accept a wrongly decided precedent as binding. What's mine is mine, what's yours is negotiable.

You have an example? And you don’t agree with him, right? And the precedent was correctly decided—everybody knows these “safe abortion clinic” refs are frauds passed in bad faith. You agree with the other four cons anyway. And further, he wants to overturn Roe anyway.

He is right that the precedent is wrong; it is, in fact, an obviously made-up rule. And its result is that states cannot pass uniform rules as if abortion was healthcare. One law for abortionists, another for everyone else.

Oh please. It is trap law deliberately designed to create undue barriers to legal abortion in a way Casey specifically proscribed. You all can repeal Roe and that’s what’s you’re going to have to do.

Casey already repealed Roe, replaced it with something different.

This is a very odd thing to say. Casey explicitly reaffirmed Roe, but added language which limited it.

It junked the trimester framework, added a newly-minted "undue burden" standard, and tried to recenter the theoretical grounding in the Due Process clause instead of "emanations and prenumbras" of unrelated rights.

It also preserved the core of Roe—as you know. If it had not, opponents of abortion rights like yourself would not have been so disappointed, if not enraged, by the decision.

I just find it odd that you're not familiar with the point about how completely it overhauled Roe in the name of stare decisis. It's a central point of Scalia's famous dissent.

Of course, I’m familiar with it. That is the famous compromise the three centrist justices (for lack of a better term) worked out. But your claim is that it is a “repeal” of Roe. That’s just wrong, lest we wouldn’t be arguing about June Medical Services.
