Announcing that a guy has resigned when you're actually firing him is a pretty inept move (what, he wasn't gonna tell anybody?), but it is not the end of democracy in America. Get a grip.

At any rate, this seems like yet another fight that will consume a huge amount of public energy on Trump's behalf, to no benefit to his re-election, no benefit to any public policy, & no benefit to his party. But other than that...

The lesson Trump seems to have taken from the past week is that a regular process & competent staff work are not important in case a legal fight ends up being decided by Chief Justice Roberts.

I believe it is typical for all US Attys to tender their resignations at the beginning of a new administration (some or all may be accepted) Berman is Acting US Atty bc Trump didn't nominate a permanent one and replacing an Acting US Atty requires a permanent replacement

If he fires him, he can’t use the vacancy act to install an acting US Attorney right? It would need to be senate confirmed.

Berman was not a presidential appointee. He was appointed by the U.S. district judges for the SDNY. Trump must appoint a replacement and the Senate must confirm.

He actually was appointed by Trump but in an acting capacity. After 120 days, with no official nomination, the judges were given th discretion to make him official until a senate confirmed replacement takes the position.
