      1) The majoritarian argument, you realize, is not apt—DACA is supported by most voters, according to pretty much every survey; 2) “anyone” in your esssy does a lot of work re reliance theory. Anyone? Probably not a strong claim. How about 700k anyones?

      Our system is designed to require majorities to work within the system, not just tell the courts that they represent the national will. Virtually every government policy creates reliance interests. If that alone excuses breaking the law, we are no longer a nation of laws.

      Oh I’m not saying the survey majority has an absolute justification here. Just pointing out that you conflated Trump’s general anti immigrant policy—which many voters apparently support—with anti-DACA—which far fewer do.

      country (as they must be by the terms of DACA.) But saying “anybody” turns 700k lives into a distant abstraction. No, those real people are screwed. Ok if you think the law requires that, but you ought to own it—700k isn’t “anybody” as the decision recognizes.

      But where do you legally draw the line, in allowing lawbreaking? "This is a lot of people" is fine for Congress. A court needs to draw lines.

      Prosecutors, rightly or wrongly (and cops too) use discretion regarding law breaking all the time. Roberts was *judging*—he used a tool of the law to put off the ultimate decision regarding a particularly sympathetic cohort. If the voters decide to re-elect Trump, they will

          Well they voted for Obama twice too and by absolute majorities. And if he been constituionally able to run again, he would waxed Trump. In the meantime, thank Roberts for his discretion, if not (if you prefer) on humane grounds, but on political ones—finding for the government
