Federal guidelines are not law; state edicts do have the force of law. In NY, restaurants can't suddenly open up and start offering sitdown service.

My point stands. Federal guidance on social distancing don't have force of law. State/city declarations do. That's why NYPD is breaking up events for a bunch of people who showed up for a video filming -- or dispersing Jewish funeral ceremonies.
