I dwell in some detail on where the standard that's actually in the document actually came from and how Hamilton, in particular, described it. It *is* more than "maladministration," but neither Hamilton nor Burke regarded it as requiring a statutory crime.

I agree. However, given there are no real teeth to keep the House from making up w/e it wants outside of the Senate's response (which has similar lack of checks), it is all political and therefore persuasive. If Dersh sways Senators, it is as good as any other argument.
