Apparently you didn't listen to the actual clip: "... IF he is permitted to defy the Congress entirely, categorically ... he is a dictator." It is a conditional statement on the consequences of taking Trump's legal arguments to their logical conclusions.

This may not diminish your critique very much, but it seemed to me that, in context, Nadler was saying that Trump fancied himself a dictator, or "has determined...[himself to be]... a dictator." As opposed to Nadler stating that Trump actually is a dictator.
