This is a ridiculous point for a number of reasons: 1 - most major liberal accomplishments were gained through the courts. 2 - In American life there are a host of things you don't need to "get" at the ballot box. Religious freedom being one of them.https://twitter.com/RadioFreeTom/status/1201346923137052672 …

This point by @AdamSerwer is important. The challenge for 21st century cons was to keep pushing the GOP to be a center-right, small govt, pro natsec party. But the social cons pinned everything on Trump getting judges to force through things the GOP can't get at the ballot box. https://twitter.com/The_Collectah/status/1201343754407481344 …

      1. I remember when conservatives swore to stop liberals from getting things through the courts as fundamentally inimical to our system of government. 2. I don't think the masses voting for Trump give a flying flamingo about religious freedom, unless that means "abortion."

What policy do conservatives want to push through the courts that is "fundamentally inimical to our system of government?"

Outlawing abortion, changing the meaning of the second amendment to mean Home Bazookas are two that come to mind, but you're being slippery here: You want the courts, not the legislature or the public, to be the vessel of ideas. The same thing cons once hated about liberals.

I think Serwer is right that conservatives have decided that state power is great if it protects ideas they know can't be sold any longer to the public. This is just court activism with a different constituency.

I think it is fair to say there is a strain of that out there. But it is a serious overgeneralization that ignores the asymmetric nature of how the two sides have used the courts for decades.

This is an incredible claim. Social conservatives have had immense success at the ballot box and in state legislatures. Then federal judges declared those results unconstitutional with novel legal concepts. Now we're fighting on the Left's preferred battlefield—and winning. https://twitter.com/RadioFreeTom/status/1201346923137052672 …
