      The Constitution does not prevent it from being enacted by statute, it just doesn't require it as the remedy, or authorize the courts to create it as such.

      The Constitution doesn’t say anything about the 4th Amendment’s remedies, though. It just says there is a right.

          I think judges are in charge of figuring out the remedy either way. The text doesn’t say, and it’s not at all clear to me that the 4a adopts remedies that happen to be found in pre4a common law s&s law.
