I take issue with big chunks of Dershowitz's argument here, but he's been making the case for a while that a president can't obstruct justice by exercising his Article II powers, which is clearly what he's referencing here. My point of disagreement is more with his view that the rejection of "maladministration" as a basis for impeachment means the Framers required a specific crime. Which is just wrong, historically.
