The case for it being illegal is that its targets are not public officials holding offices of public trust. Banning political speech is always a dicey business.

Did my 3L paper in law school on First Amendment Exclusionary Rules. These issues arise in many areas of the law. I'm particularly skeptical of applying them to bar disclosure of matters of public concern about public officials, absent a threat to national security.

Republicans SHOULD be held to a higher standard, because when they get caught in affairs of any sort it goes against everything they claim to stand for. The issue is hypocrisy. If they didn’t claim to be for family values, it wouldn’t be any more newsworthy.
