The issue with this claim is that this is not a case where the staffer came forward and said she felt pressure or uncomfortable in any way, shape, or form. And people keep talking about her age as if Hill wasn’t 30 when this happened.

She's dead to rights on the campaign staffer - which is precisely why the pictures matter. And the denials on the House staffer look pretty flimsy at this point.

The case for it being illegal is that its targets are not public officials holding offices of public trust. Banning political speech is always a dicey business.

Did my 3L paper in law school on First Amendment Exclusionary Rules. These issues arise in many areas of the law. I'm particularly skeptical of applying them to bar disclosure of matters of public concern about public officials, absent a threat to national security.
