How does this contradict that? The Senate can resolve whatever it wants, it just can't stop the House. I agree that the "due process" language is silly, but otherwise it's just laying out an argument about House precedent.

Yes, the senate can resolve whatever it wants, but given that all constitutional authority rests with the House, it’s transparently absurd to object to what the House is doing. As for past practice”, an n of three isn’t much to work with.

The Senate is the jury. It's not as if the outcome of this process will never be dropped in the Senate's lap for decision. I agree past precedent isn't binding, but a lot of careful thought went into earlier decisions - some of it by Graham. In the absence of rules, it matters.
