This is always the hole in the argument from "constitutional conservatives." That and it's not actually in the Constitution, which set up a system that clearly allows for a minority to win the presidency, the Senate and the House.

OK, but the current discourse is not "I'm OK with a assault weapons ban once you get the President, House, Senate and Supreme Court on board." It's more along the lines that nobody ever has the right to enact that policy.
