Further, the Constition is a living document that is obviously not perfect, which is one reason we have those little things called Amendments.
The whole point of Wilsonian "living Constitutionalism" is that the Constitution can be changed by a majority of judges without popular amendment, which is the tradition Hayes is invoking here.
