.@KamalaHarris is about to announce in NH that as president she’d take executive action to ban imports of AR-15-style assault weapons. It would apply to 44 AR-type models in the Assault Weapons Ban of 2019.

As president, I’ll give Congress 100 days to send legislation to my desk to stop Big Pharma from raking in massive profits at the expense of Americans. If Congress won’t act, I will.

EO’s are not by nature necessarily usurping legislative power. And how many are reversing previous EO’s. The fact is that the Administrative state is massive, has been delegated far too much authority and independence from Congress, and has to be managed by the President.

I’m not disputing that. It’s just moronic to assume someone (or an entire party) doesn’t know how government works when they’re *clearly* stating they plan to use executive action to enact laws

But EO’s enacting laws is not how government works... But if the point is that they’re actually speaking about things in their purview (EO’s) vs. legislation, then I agree with that point. It’s wrong, but the whole idea of a President running on legislation is backwards itself.

Executive orders have the force of law. At this point we’re just have a disagreement on semantics.

The constitution does not authorize presidents to make domestic law against the wishes of Congress. That's an inherently legislative function.

So we’re taking a leap of faith and assuming the senate won’t be flipped in 2020

This is a non-sequitur. Candidate is stating they’ll sign EO’s that are purely legislative in nature if Congress doesn’t act. Congress acting and forgoing the need to to sign such EO’s doesn’t make that pronouncement any less unconstitutional.
