I think Hatch was wrong to say what he did; Garland was & is no more a moderate than Breyer is. I agree Garland would have come off as bland in a hearing. But how many people watched the Breyer hearings?

But then what’s the worry? And sure, I agree with you: yes, another Breyer flips the court on the issues Rs care about most. This was a BFD. But Hatch wasn’t “wrong” as if he were evaluating merits. He was cynical. He didn’t believe Obana would nominate Garland.

Cynicism—sheer bad faith—even when obvious (as with the census case, another example) is the one thing that adversaria interlocutors never stipulate. Facts, ideological disagreement—sure. But McConnell and Hatch’s not just icing the nomination, but doing it in a dishonest way?
