This is not the relevant metric. Major cases that draw massive media coverage, especially those with large partisan implications, are where ideological and partisan splits are salient.https://twitter.com/jadler1969/status/1143886751381053441 …

At #SCOTUS, the four liberal justices win the day, anchoring the majority opinions in all three decisions today. There are still more 4 libs +1 majorities in 5-4 cases than 5-4 Right-Left splits thus far this term.

I mean, Haymond and Kisor are both definitely ideologically split fights. In Haymond, Gorsuch is continuing a pattern of siding with the liberals in some criminal cases. In Kisor, Roberts kept things from getting tricky (at least for now).

Right, but that makes my point. Criminal cases (and first amendment direct cases) aren’t salient to the highest degree. A case with enormous partisan implications like the census questionnaire or gerrymandering is. As are social conservative cases (which the Court seems to be

I would argue that, outside of bitter partisans, the cases that are by *far* the most important and salient are criminal justice ones. It's particular kind of myopia peculiar to us in the chattering classes that sees it otherwise, and it's upsettingly wrong.

Right—but again that is not at all what I mean by *political* salience. The census case is a perfect if example of what I mean. Let’s see how the votes and theories of the case go to tomorrow. We are likely see an unusual deference shown to the administrative state

Right, so, rather than be dismissive of broad, important areas of the law where the justices are coming together in unexpected ways, why don't you just say what you're critiquing and criticize that?
