Landowners need not go to state court to seek inverse condemnation before pressing federal takings claim against state and local governments. This is a major step away from treating private property as a second-class right. /2

Not surprising that Court splits along traditional right-left lines in Knick. Perhaps surprising that CJ Roberts authored majority opinion. Property rights groups were suspicious of his nomination b/c he argued Tahoe case for gov't side. /3
