      Reminder: in 2015 MLB punted the issue of netting to the individual clubs, making a "recommendation" of expanded netting as opposed to a mandate. It'd take a couple of years and a girl getting severely injured in New York to inspire all 30 teams to respond to the recommendation.

      The paired that recommendation with a suggestion of "fan education," which strongly implied MLB believed it was fans' responsibility to guard against balls screaming off bats at 110 mph rather than for the league to protect fans.

      It does not take a genius to realize that proceeding in that was aimed at maintaining the almost complete immunity from legal liability for fan injuries the game has long enjoyed.

      MLB has long been safe from being held responsible for such things due to ticket disclaimers and assumption of the risk arguments. I question if that'll last forever given the awareness -- created as a marketing gimmick by MLB -- of just how fast batted balls fly.

      The assumption of the risk calculus has long been based, I suspect, on the idea most people have that balls can be easily avoided if you're alert enough. When you spend years sharing eye-popping video of insane exit velocity, though, the calculus changes.

      There are limits to assumption of the risk. If a company says "our product is so dangerous only the most elite athletes can react in time" you cannot reasonably ask joe schmo to fend for themselves.

          The nature of the way it is being spread makes a difference, though, right? It's not "Warning: 110mph balls heading your way!" It's "WOW, COOL! ISN'T THiS THE BEST!" It's like "Wow, kids, look how fast and with how much force these lawn darts drop!"
